These Terms include important disclaimers, limitations of liability, and provisions governing disputes. Trampoline Health is a general wellness service. It is not therapy, medical care, psychiatric care, crisis counseling, diagnosis, treatment, or a substitute for professional care.

The Service is designed to support general wellness, self-awareness, habit formation, emotional resilience, personal growth, and digital wellbeing. The Service is intended for personal, non-commercial use unless we expressly agree otherwise in writing.
Trampoline Health may modify, suspend, discontinue, or replace any part of the Service at any time, with or without notice, subject to applicable law.
3. Important Wellness Disclaimer
Trampoline Health is a general wellness service. It is not therapy, psychotherapy, counseling, medical care, psychiatric care, crisis counseling, diagnosis, treatment, or a substitute for care from a licensed medical or mental health professional.
Trampoline Health does not diagnose, treat, cure, prevent, or mitigate any disease, disorder, condition, mental illness, addiction, disability, or medical or psychological condition. No content, feature, exercise, recommendation, notification, report, community interaction, support communication, or other information available through the Service should be interpreted as medical advice, mental health advice, clinical advice, psychiatric advice, therapeutic advice, or a treatment plan.
You are responsible for deciding whether the Service is appropriate for you. If you have questions or concerns about your physical, mental, emotional, or medical wellbeing, you should consult a qualified professional.
4. No Professional Relationship
Your use of the Service does not create a physician-patient, therapist-client, counselor-client, psychologist-patient, psychiatrist-patient, clinician-patient, fiduciary, or other licensed professional relationship between you and Trampoline Health, any Trampoline Health personnel, any community member, any Accountability Partner, or any third-party service provider.
Any Wellness Content or support provided through the Service is for general informational, educational, accountability, and wellness purposes only.
5. Not a Crisis Service
The Service is not designed for emergencies, crisis situations, suicide prevention, self-harm intervention, domestic violence intervention, abuse reporting, medical emergencies, psychiatric emergencies, or situations involving risk of harm to yourself or others.
Trampoline Health does not provide emergency response, crisis counseling, real-time monitoring, safety checks, or active intervention. We do not guarantee that we will review, detect, respond to, or escalate any User Content, message, post, log, reflection, or other activity suggesting distress, crisis, self-harm, or harm to others.
If you believe you may harm yourself or someone else, are experiencing a medical or mental health emergency, or need urgent support, call emergency services in your area immediately. In the United States, you may call or text 988 for the Suicide & Crisis Lifeline. Outside the United States, contact your local emergency number or crisis hotline.
You agree not to use the Service as your only source of support during a crisis. Trampoline Health may, but has no obligation to, take actions it believes are appropriate for safety, legal, moderation, or platform-protection reasons, including restricting account access, removing content, contacting emergency services, or reporting content where permitted or required by law.
6. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal authority to enter into these Terms.
You may not use the Service for or on behalf of another person unless you have all legally required authority and consent. You may not create an account using false information or impersonate another person.
7. Accounts and Account Security
You may be required to create an account to access some or all features of the Service. You agree to provide accurate, current, and complete information and to keep your account information updated.
You are responsible for maintaining the confidentiality and security of your account credentials and for all activity that occurs under your account. You agree to notify us promptly if you believe your account has been compromised or used without authorization.
Trampoline Health is not responsible for any loss or harm arising from unauthorized access to your account resulting from your failure to protect your credentials, devices, or communications.
8. Authorized Use of Devices and Accounts
You may use the Service only with accounts, devices, browsers, and systems that you own or are authorized to use.
You may not install, enable, or use the Service to monitor, restrict, collect information from, or control another person’s device, account, app usage, browser activity, communications, or online activity without all legally required rights, notices, and consents.
You are responsible for complying with all laws that apply to your use of the Service, including laws relating to privacy, device access, electronic communications, monitoring, consent, and data protection.
9. Wellness Exercises, Triggers, Setbacks, and Reflections
The Service may allow you to complete wellness exercises, log setbacks, identify triggers, reflect on emotions, set goals, track personal patterns, receive prompts, and view summaries or insights.
These tools are intended to support self-awareness and general wellness habits. They are not clinical assessments and should not be used to diagnose, treat, predict, prevent, mitigate, or manage any medical, psychiatric, psychological, behavioral health, or substance use condition.
You are responsible for how you use these tools and for deciding whether a particular exercise, prompt, reflection, or activity is appropriate for you. Some content may feel uncomfortable or emotionally challenging. You should stop using any feature that feels unsafe or harmful and seek support from a qualified professional when appropriate.
10. Digital Wellness Tools
The Service may include tools that help you set digital wellness goals, block or limit apps or websites, schedule breaks, manage screen time, reduce distractions, or create healthier technology habits.
These tools are provided for convenience and general wellness purposes only. Trampoline Health does not guarantee that blocking, scheduling, reminders, notifications, or other digital wellness features will be uninterrupted, error-free, effective, or suitable for your needs.
You remain responsible for your device use, account settings, permissions, third-party platform settings, and any consequences of enabling, disabling, bypassing, or relying on digital wellness tools.
11. Wellness Support; No Therapy or Clinical Services
If Trampoline Health offers wellness support, guides, facilitators, moderators, accountability features, group support, community events, or similar human support, those services are provided only for general wellness, accountability, education, lifestyle support, product guidance, and community safety.
Trampoline Health personnel do not provide therapy, psychotherapy, counseling, psychiatric care, medical care, diagnosis, treatment, crisis counseling, or other licensed health care services through the Service. Trampoline Health personnel may offer general encouragement, educational information, wellness prompts, accountability support, moderation, or help using the Service, but they do not assess, diagnose, treat, or manage mental health conditions, substance use disorders, self-harm risk, trauma, eating disorders, or any other medical or psychological condition.
You are solely responsible for deciding whether to use or rely on any information, prompt, exercise, support communication, or suggestion available through the Service.
12. Community Features
The Service may include community features, including groups, comments, posts, chats, messages, reactions, profiles, forums, events, accountability features, or other ways to interact with other users.
Community features are intended for peer support, encouragement, accountability, and general wellness discussion. Community content is not professional advice and should not be treated as medical, mental health, therapeutic, legal, financial, or other professional guidance.
You understand that other users are solely responsible for their own User Content. Trampoline Health does not guarantee that community content will be accurate, safe, helpful, appropriate, or suitable for you.
You use community features at your own risk.
13. Community Standards
If you use community features, you agree not to post, transmit, encourage, facilitate, or otherwise make available content that:
Encourages self-harm, suicide, eating disorder behavior, substance abuse, violence, harassment, abuse, exploitation, or illegal conduct;
Provides or requests medical, psychiatric, therapeutic, legal, financial, or other professional advice;
Diagnoses, treats, shames, threatens, targets, exploits, or harasses another person;
Contains another person’s private, identifying, medical, mental health, financial, or sensitive information without permission and lawful authority;
Is sexually explicit, exploitative, hateful, discriminatory, defamatory, invasive, fraudulent, deceptive, or otherwise objectionable;
Promotes bullying, stalking, intimidation, doxxing, impersonation, or unwanted contact;
Infringes or violates another person’s intellectual property, privacy, publicity, contractual, or other rights;
Contains malware, harmful code, spam, scams, unauthorized advertising, or misleading information;
Interferes with the safety, privacy, wellbeing, or experience of other users;
Attempts to move users into unsafe, exploitative, or unmoderated interactions; or
Violates any applicable law, regulation, or these Terms.
Trampoline Health may remove content, restrict accounts, disable features, report content, or take other action in its discretion. We do not undertake to review all User Content and do not guarantee that objectionable content will be removed or that users will comply with these Terms.
14. User Content
You retain ownership of your User Content, subject to the rights granted in these Terms.
You are solely responsible for your User Content and for the consequences of submitting, posting, sharing, or transmitting it. You represent and warrant that:
You own or have all necessary rights, consents, and permissions to submit and share your User Content;
Your User Content does not violate these Terms, applicable law, or any third-party rights;
Your User Content does not contain another person’s personal, sensitive, medical, mental health, financial, or identifying information unless you have lawful authority and all required consents; and
Your User Content is not false, misleading, harmful, unlawful, or otherwise inappropriate for the Service.
Trampoline Health is not responsible for User Content posted, shared, or transmitted by users or third parties. We may, but are not obligated to, monitor, review, edit, remove, restrict, or disable access to User Content at any time and for any reason.
15. License to User Content
By submitting, posting, uploading, transmitting, or otherwise making User Content available through the Service, you grant Trampoline Health a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, process, modify, adapt, publish, display, perform, distribute, transmit, and otherwise use your User Content solely for the purposes of operating, providing, maintaining, securing, moderating, improving, developing, and promoting the Service, and as otherwise described in our Privacy Policy.
This license includes the right to use User Content to generate aggregated, anonymized, or de-identified information, subject to our Privacy Policy and applicable law.
You may delete certain User Content through available Service functionality, but deletion may not remove copies already shared with others, retained in backups, used for safety, security, legal, or compliance purposes, or otherwise retained as permitted by law and our Privacy Policy.
16. Sensitive Information
You understand that information you choose to enter into the Service may include sensitive personal information, including reflections about your mood, emotions, habits, setbacks, triggers, relationships, goals, app usage, community participation, or personal experiences.
You should not submit information that you do not want processed in accordance with our Privacy Policy. You agree not to submit another person’s personal, sensitive, medical, mental health, financial, or identifying information without lawful authority and all required consents.
Trampoline Health may process, retain, disclose, delete, restrict, or otherwise handle information as described in the Privacy Policy and as permitted or required by law.
17. Privacy Policy
Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, disclose, and protect information. By using the Service, you acknowledge and agree that Trampoline Health may collect and use information as described in the Privacy Policy.
If there is a conflict between these Terms and the Privacy Policy regarding the handling of personal information, the Privacy Policy will control to the extent of the conflict.
18. Product Improvement and De-Identified Insights
Trampoline Health may use information collected through the Service to operate, maintain, protect, analyze, and improve the Service; develop new features; understand general wellness engagement; personalize experiences; troubleshoot issues; maintain safety and security; and generate aggregated, anonymized, or de-identified insights.
Trampoline Health will not represent aggregated, anonymized, or de-identified insights as clinical research, medical conclusions, treatment outcomes, or proof of therapeutic effectiveness unless supported by appropriate review, evidence, consent, and legal compliance.
19. Automated Features
The Service may use automated systems, algorithms, artificial intelligence, machine learning, or similar technologies to personalize content, suggest wellness exercises, identify patterns, summarize activity, recommend features, moderate content, or support product functionality.
Automated outputs may be incomplete, inaccurate, outdated, or inappropriate for your circumstances. Automated outputs are not medical, mental health, therapeutic, diagnostic, legal, financial, or professional advice. You are responsible for independently evaluating any automated output before relying on it.
20. Reports, Scores, Logs, and Insights
Any reports, scores, streaks, summaries, logs, insights, analytics, badges, progress indicators, or similar features provided through the Service are for personal reflection, general wellness, habit-building, and informational purposes only.
They are not medical records, clinical assessments, diagnostic tools, treatment recommendations, psychological evaluations, employment evaluations, legal records, or proof of any medical, mental health, behavioral, or psychological condition.
Trampoline Health does not endorse the use of Service reports, logs, community posts, or app data as evidence in legal, employment, insurance, custody, disciplinary, medical, clinical, or similar proceedings.
21. No Guaranteed Results
Trampoline Health does not guarantee that use of the Service will make you happier, more resilient, mentally stronger, emotionally fit, less stressed, less anxious, less depressed, more productive, more connected, or otherwise produce any specific result.
Individual experiences vary. The Service is intended to support general wellness habits, not to produce clinical, medical, psychological, financial, employment, educational, relational, or other guaranteed outcomes.
22. Educational and Informational Content
Wellness Content made available through the Service is provided for general informational, educational, accountability, and wellness purposes only.
Trampoline Health may update, modify, remove, or discontinue Wellness Content at any time. While we aim to provide useful wellness content, we do not guarantee that any content is accurate, complete, current, appropriate, effective, or suitable for your circumstances.
23. Assumption of Risk
You understand and agree that wellness practices, reflection exercises, community discussions, digital habit changes, accountability features, emotional self-work, and related activities may feel uncomfortable, may not be suitable for everyone, and may not produce the results you expect.
You voluntarily use the Service at your own risk and are responsible for deciding whether to participate in any exercise, feature, community interaction, digital wellness activity, or other part of the Service.
You should consult a qualified professional before using the Service if you have questions about your physical, mental, emotional, or medical wellbeing.
24. Acceptable Use
You agree that you will not:
Use the Service for any unlawful, harmful, fraudulent, abusive, harassing, exploitative, or unauthorized purpose;
Use the Service as therapy, medical care, psychiatric care, crisis support, diagnosis, treatment, or a substitute for professional care;
Use the Service to provide medical, psychiatric, therapeutic, legal, financial, or other professional advice to others;
Interfere with, disrupt, damage, overload, or impair the Service or its systems;
Attempt to gain unauthorized access to the Service, accounts, systems, networks, data, or other users’ information;
Use bots, scrapers, crawlers, automated tools, or other unauthorized methods to access, copy, or extract data from the Service;
Reverse engineer, decompile, disassemble, modify, translate, or create derivative works of the Service except as permitted by law;
Copy, sell, resell, lease, rent, sublicense, distribute, or commercially exploit the Service without our written permission;
Upload, transmit, or distribute viruses, malware, harmful code, spam, scams, or other harmful materials;
Circumvent, disable, interfere with, or bypass security, moderation, access control, payment, subscription, or digital wellness features;
Use the Service to monitor, control, or collect information from another person’s device, account, or activity without lawful authority and required consent;
Infringe or violate intellectual property, privacy, publicity, contractual, or other rights;
Misrepresent your identity, affiliation, credentials, qualifications, or authority;
Use the Service in a way that creates risk of harm, liability, or legal exposure for Trampoline Health, other users, or third parties; or
Encourage or assist anyone else in doing any of the above.
25. Ownership and Intellectual Property
The Service, including all software, designs, text, graphics, images, audio, video, content, exercises, prompts, workouts, methods, workflows, interfaces, trademarks, logos, trade names, service marks, and other materials, is owned by Trampoline Health or its licensors and is protected by intellectual property and other laws.
Except for the limited rights expressly granted to you in these Terms, Trampoline Health and its licensors reserve all rights, title, and interest in and to the Service.
You may not use the Trampoline Health name, trademarks, logos, branding, or other proprietary materials without our prior written permission.
26. Limited License
Subject to your compliance with these Terms, Trampoline Health grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal, non-commercial wellness purposes.
This license does not include any right to copy, modify, distribute, sell, lease, reverse engineer, decompile, disassemble, create derivative works from, publicly display, publicly perform, or otherwise exploit the Service except as expressly permitted by these Terms or applicable law.
We may terminate this license at any time if you violate these Terms or if we suspend, restrict, or terminate your access to the Service.
27. Feedback
If you submit suggestions, comments, ideas, improvements, feature requests, or other feedback about the Service, you grant Trampoline Health a worldwide, perpetual, irrevocable, royalty-free, sublicensable, transferable license to use, reproduce, modify, distribute, display, perform, commercialize, and otherwise exploit that feedback without restriction or compensation to you.
You agree that Trampoline Health has no obligation to keep feedback confidential or to use your feedback.
28. Third-Party Services and Links
The Service may integrate with, link to, or rely on third-party platforms, app stores, payment processors, analytics providers, hosting providers, browser platforms, device operating systems, websites, content, or services.
Trampoline Health does not control and is not responsible for third-party services. Your use of third-party services may be subject to separate terms, privacy policies, fees, permissions, and settings. You are responsible for reviewing and complying with those third-party terms.
We do not guarantee that third-party services will be available, secure, accurate, compatible, or error-free.
29. App Stores and Platform Providers
If you download or access the Service through the Apple App Store, Google Play, Chrome Web Store, or another platform provider, you acknowledge that these Terms are between you and Trampoline Health, not the platform provider.
The platform provider is not responsible for the Service or its content. Your use of the Service may also be subject to the applicable platform provider’s terms, conditions, and policies.
To the extent required by a platform provider’s terms, the platform provider and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you.
30. Purchases and Subscriptions
Trampoline Health may offer free features, paid features, subscriptions, trials, promotional offers, or other purchase options.
If you purchase a subscription, you authorize Trampoline Health or its third-party payment processor or applicable app store provider to charge your selected payment method for the subscription fees, applicable taxes, and any other disclosed charges.
Unless otherwise stated at the time of purchase, subscriptions automatically renew at the end of each billing period until canceled. You must cancel your subscription before it renews to avoid being charged for the next billing period.
Subscription features are available only while your subscription is active and in good standing.
31. Billing, Renewal, and Price Changes
You are responsible for keeping your payment information accurate and up to date. If a payment is not successfully processed, we may suspend, restrict, or terminate your access to paid features.
We may change subscription plans, features, pricing, or billing terms from time to time. Unless otherwise required by law or stated at the time of change, price changes will take effect after notice to you and upon your next billing cycle.
If your subscription is purchased through an app store or third-party platform, billing, cancellation, refunds, and payment disputes may be governed by that platform’s policies.
32. Cancellation
You may cancel your subscription at any time through the account settings, app store, payment platform, or cancellation method made available for your subscription.
Cancellation will stop future renewal charges but will not automatically result in a refund for the current billing period unless required by law or expressly stated in these Terms or at the time of purchase.
If you need help locating the applicable cancellation method, you may contact us at support@trampolinehealth.co.
33. Refunds
Except where required by law or expressly stated at the time of purchase, all purchases are final and non-refundable. We do not provide refunds or credits for partially used subscription periods, unused features, accidental purchases, dissatisfaction, failure to cancel, or periods during which the Service is unavailable or unused.
If your purchase was made through an app store or third-party platform, refund requests may need to be submitted directly to that platform and will be subject to its refund policies.
Trampoline Health may, in its sole discretion, provide refunds, credits, or other accommodations on a case-by-case basis. Providing a refund or accommodation in one instance does not require us to do so in any other instance.
34. Promotions and Discount Codes
Trampoline Health may offer promotions, trials, discounts, referral offers, or special pricing from time to time. Promotions may be subject to additional terms and may be modified, suspended, or discontinued at any time.
Unless otherwise stated, promotions apply only to the initial promotional period, are not transferable, may not be combined with other offers, have no cash value, and may be limited to new users.
At the end of a free trial or promotional period, your subscription may automatically renew at the then-current price unless you cancel before the trial or promotional period ends.
35. Availability, Updates, and Changes to the Service
The Service may be updated, modified, interrupted, suspended, limited, or discontinued at any time. We may add, remove, modify, or replace features, content, workouts, tools, integrations, subscription plans, pricing, or availability.
We do not guarantee that the Service will be uninterrupted, timely, secure, accurate, complete, or error-free. The Service may be unavailable due to maintenance, updates, system failures, third-party services, network issues, platform restrictions, legal requirements, force majeure events, or other circumstances.
You agree that Trampoline Health will not be liable for any interruption, suspension, modification, discontinuation, delay, error, or unavailability of the Service.
36. Communications
By creating an account or using the Service, you consent to receive communications from Trampoline Health, including service announcements, account notices, security alerts, subscription notices, product updates, wellness reminders, and marketing communications where permitted by law.
You may opt out of certain marketing communications by following the unsubscribe instructions or changing your notification settings. You may not be able to opt out of essential transactional or service-related communications.
You understand that electronic communications may not always be secure and may be delayed, misdirected, intercepted, corrupted, lost, or incomplete. You are responsible for maintaining secure access to your email, devices, accounts, and communications.
37. Safety-Related Suspension or Termination
Trampoline Health may suspend, restrict, or terminate your access to the Service, remove User Content, limit community participation, disable features, or take other actions if we believe, in our discretion, that:
You violated these Terms or any applicable law;
Your conduct may create risk for another user or third party;
Your conduct may expose Trampoline Health to liability;
Your account presents a safety, legal, security, moderation, abuse, fraud, or platform-integrity concern;
You misuse community, accountability, digital wellness, or support features;
You fail to pay required fees; or
We discontinue or materially change the Service.
Upon termination, your right to access and use the Service will immediately cease. Any provisions that by their nature should survive termination will survive, including provisions relating to intellectual property, User Content licenses, disclaimers, limitations of liability, indemnification, dispute resolution, and governing law.
38. Disclaimer of Warranties
To the maximum extent permitted by law, the Service is provided on an “as is,” “as available,” and “with all faults” basis, without warranties of any kind, whether express, implied, statutory, or otherwise.
Trampoline Health disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, reliability, uninterrupted operation, and any warranties arising from course of dealing or usage of trade.
Trampoline Health does not warrant that:
The Service will meet your needs or expectations;
The Service will produce any particular wellness, emotional, behavioral, productivity, or personal outcome;
The Service will be uninterrupted, secure, timely, accurate, complete, or error-free;
Any defects or errors will be corrected;
Any content, recommendation, insight, report, exercise, prompt, automated output, or community interaction will be accurate, helpful, safe, suitable, or effective;
Digital wellness tools will successfully block, limit, restrict, or manage apps, websites, content, or device usage; or
The Service will be free of viruses, harmful code, unauthorized access, or other security issues.
Some jurisdictions do not allow certain warranty disclaimers, so some disclaimers may not apply to you.
39. Limitation of Liability
To the maximum extent permitted by law, Trampoline Health and its owners, officers, directors, employees, contractors, affiliates, licensors, service providers, moderators, guides, agents, and representatives will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or enhanced damages; loss of profits, revenue, goodwill, data, use, or opportunity; emotional distress damages; personal injury damages; or damages arising from your reliance on the Service, Wellness Content, User Content, community content, automated outputs, digital wellness tools, reports, reminders, subscriptions, third-party services, or support communications.
To the maximum extent permitted by law, Trampoline Health’s total liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of:
The amount you paid to Trampoline Health for the Service in the three months before the event giving rise to the claim; or
One hundred U.S. dollars ($100).
These limitations apply whether the claim is based on warranty, contract, tort, negligence, strict liability, statute, or any other legal theory, even if Trampoline Health has been advised of the possibility of damages and even if any limited remedy fails of its essential purpose.
Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.
40. Indemnification
You agree to defend, indemnify, and hold harmless Trampoline Health and its owners, officers, directors, employees, contractors, affiliates, licensors, service providers, moderators, guides, agents, and representatives from and against any claims, demands, actions, damages, losses, liabilities, judgments, settlements, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:
Your access to or use of the Service;
Your User Content;
Your violation of these Terms;
Your violation of any law, regulation, or third-party right;
Your interactions with other users, Accountability Partners, community members, or third parties;
Your reliance on Wellness Content, community content, automated outputs, reports, digital wellness tools, or support communications;
Your unauthorized use of another person’s device, account, information, or content;
Your misuse of the Service as therapy, medical care, crisis support, diagnosis, treatment, or professional advice; or
Any dispute between you and another user, Accountability Partner, community member, or third party.
Trampoline Health reserves the right to assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense of such claims.
41. Release
To the maximum extent permitted by law, you release Trampoline Health and its owners, officers, directors, employees, contractors, affiliates, licensors, service providers, moderators, guides, agents, and representatives from any claims, demands, damages, losses, liabilities, and expenses arising out of or relating to:
Your use of or inability to use the Service;
Your reliance on Wellness Content, User Content, community content, automated outputs, reports, digital wellness tools, or support communications;
Your interactions with other users, Accountability Partners, community members, or third parties;
Any emotional discomfort, distress, disappointment, or dissatisfaction arising from use of the Service;
Any failure of the Service to provide warnings, detect emergencies, intervene in crises, or produce specific results; and
Any content, conduct, or information provided by users or third parties.
If you are a California resident, you waive California Civil Code Section 1542, which says: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in the creditor’s or releasing party’s favor at the time of executing the release and that, if known by the creditor or releasing party, would have materially affected the creditor’s or releasing party’s settlement with the debtor or released party.”
You also waive any similar law of any other jurisdiction to the extent permitted by law.
42. Dispute Resolution; Informal Resolution
Before filing a claim, you and Trampoline Health agree to try to resolve the dispute informally. A party seeking to bring a dispute must first send written notice to the other party describing the nature and basis of the dispute and the requested relief.
Notices to Trampoline Health must be sent to support@trampolinehealth.co with the subject line “Legal Dispute Notice.”
The parties will attempt to resolve the dispute informally for 60 days after the notice is received. If the dispute is not resolved within that period, either party may proceed as permitted by these Terms.
43. Governing Law and Venue
These Terms and any dispute arising out of or relating to these Terms or the Service will be governed by the laws of the State of Delaware, without regard to conflict-of-law principles.
Subject to any dispute resolution provisions that may apply, you and Trampoline Health agree that the state and federal courts located in Delaware will have exclusive jurisdiction and venue over any dispute arising out of or relating to these Terms or the Service. You consent to personal jurisdiction in those courts.
44. Injunctive Relief
You agree that a breach of provisions relating to intellectual property, unauthorized access, misuse of the Service, confidentiality, or prohibited conduct may cause Trampoline Health irreparable harm for which monetary damages may be inadequate.
Trampoline Health may seek injunctive or equitable relief without posting a bond or proving actual damages, in addition to any other remedies available at law or in equity.
45. Compliance with Laws
You are responsible for complying with all laws, rules, and regulations that apply to your access to and use of the Service, including laws relating to privacy, data protection, consumer protection, electronic communications, device access, monitoring, intellectual property, and online conduct.
You may not use the Service in any jurisdiction or manner where use would be unlawful or would subject Trampoline Health to legal or regulatory obligations not expressly accepted by us in writing.
46. Export and Sanctions Compliance
You may not access, use, export, re-export, or transfer the Service except as authorized by U.S. law and the laws of the jurisdiction where the Service is accessed or used.
You represent and warrant that you are not located in, organized under the laws of, or ordinarily resident in any country or region subject to comprehensive U.S. sanctions, and that you are not listed on any U.S. government restricted-party list.
47. Changes to These Terms
We may modify these Terms from time to time. When we make changes, we may update the effective date and provide notice as required by law or as we determine appropriate.
Your continued access to or use of the Service after updated Terms become effective means you accept the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
48. Assignment
You may not assign, transfer, or delegate these Terms or your rights or obligations under these Terms without our prior written consent.
Trampoline Health may assign, transfer, or delegate these Terms or any rights or obligations under these Terms at any time, including in connection with a merger, acquisition, reorganization, sale of assets, financing, change of control, or operation of law.
49. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.
50. No Waiver
Our failure to enforce any provision of these Terms will not be considered a waiver of that provision or any other provision. Any waiver must be in writing and signed by an authorized representative of Trampoline Health.
51. No Third-Party Beneficiaries
Except as expressly stated in these Terms, these Terms do not create any third-party beneficiary rights.
52. Entire Agreement
These Terms, together with the Privacy Policy and any additional terms or policies expressly incorporated by reference, constitute the entire agreement between you and Trampoline Health regarding the Service and supersede all prior or contemporaneous understandings, agreements, representations, and warranties regarding the Service.
